Beta Testing Notice

The Foundry is currently in beta testing. These terms, the Service, and its features are subject to change at any time without notice. Access may be modified, suspended, or terminated during this period.

1. Acceptance of Terms

By accessing or using The Foundry ("Service"), operated by The Foundry ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and The Foundry governing your use of the application available at back2ops.com.

You may register using Google OAuth. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at foundry@back2ops.com.

5. Use of Your Content During Beta Testing

By using the Service during beta testing, you grant The Foundry a non-exclusive, worldwide, royalty-free license to access, use, analyze, and reproduce any content, data, or information you enter into the application for the purposes of testing, debugging, developing, and improving the Service.

This includes but is not limited to: 3D model files, node configurations, team data, and any other content submitted through the Service. We will handle this information in accordance with our Privacy Policy.

The Service integrates with Google Drive and Google Sheets. Your use of those services is subject to Google's own Terms of Service and Privacy Policy. We are not responsible for the availability or conduct of third-party services.

The Service and its original content, features, and functionality are and will remain the exclusive property of The Foundry. You retain ownership of content you upload, subject to the license granted in Section 5.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE FOUNDRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service ceases immediately.

We may update these Terms at any time. We will notify registered users of material changes by email or by posting a notice within the Service. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York.
